Palm Gets Legal on the Palm Pre Android Theme

Citing a number of copyright and trademark infringements on its name, images and icons, Palm is taking the creators of the Android app “Palm Pre Android Theme” to task, and maybe to court. So far we have the classic Cease and Desist from Palm to the App creators. Entrenched in some light legalese, here’s the gist of what Palm had to say: “While Palm appreciates that imitation is the most sincere form of flattery, we are concerned that the use of the name ‘Palm Pre Android Theme’ for your product is likely to cause people to erroneously assume that your application is sponsored, authorized or has been approved by Palm, or that you have, or your company has, a relationship with Palm. Creation of such consumer confusion would constitute an infringement of Palm’s well-established trademark rights.” The date that the company has to cease using and distributing the app has been redacted in the letter, but we can assume it’s within the very near future.
